The copyright date is not supposed to be the current date, it is supposed to be the date that the work was created and fixed in tangible form.
Some may interpret this as the date the work is originally published or distributed.

But surely the New Years logo/Changing away from the new years logo would mean that it was different and hence made in 2009

The copyright mark isn't even necessary, in fact it was placed there so users would know the page had finished loading. I just noticed it hadn't been updated...
