I'm sorry, but I really don't have a lot of compassion for this one. They were on a public beach in plain sight of everyone having sex. If they didn't want to be seen, they should have kept it in private.

According to Reuters, "Some copies of the video have been taken off the site but users have reposted it." So the problem becomes one of pre-moderation, which isn't trivial considering the upload volume YouTube must get...

In future we will see more of that as many new YouTube-like sites pay you for videos, especially those driving traffic. So amateur paparazzi will swarm the beaches and parties and hunt down celebrities.

I can even imagine a new "happy slapping" wave.

Did the author of the video contact them? Or is recording videos of (half-celebrity) people in public places illegal?

I'm no lawyer, so I could be wrong, but I thought that making recordings (video or audio) of *anyone* and publishing the video without their consent was illegal...

Tony: I'm no lawyer either, but I'd say that's unlikely, or the paparazzi would all be in prison by now (not to mention regular journalists). Alternatively, I know that film makers need to get everyone filmed to sign a release form, but I think films are different.

I think the issue here is one of privacy, and I dare say the rules change a lot depending on what country you're in.

Personally I find it (disturbingly) hilarious how oblivious and overreaching some judges are. Brazilian judge says 'shut down all of YouTube to prevent people seeing *1* video clip'. Good luck with that.

At least *photographing* people in the US is legal, from what I remember. In Germany, AFAIK, it's not legal unless these persons are celebrities. But yeah, we need a lawyer here :)

Seems as if they are going to take a similar approach to what European courts have done in the past with Microsoft. To fine them daily until they comply with the court order.

Second ISP blocks YouTube in Brazil... First was Brasil Telecom, now it's Telefônica! A third one, Embratel, it's also studying the same possibility!
