Can google legally do stuff like this?? I mean for crying out loud, can google run after everyone that uses oogle??? Besides the main thing chmoogle was for was chemistry search, something that google doesn't even do. |
a quote from chmoogle page..
<Although we are convinced we will prevail before the USPTO and/or the Courts against Google's claim of infringement, they have billions, and we are just a bunch of scientists trying to advance science one step further by providing a search that Google can't do.>

I would ask this: what association do the "Chmoogle" creators want to achieve? I'm sure they want to achieve the association "Chemistry + Google", a chemistry search site. So in that regard, they're clearly backriding on Google. *However*, as "to google" has become an official verb in English language (and other languages), can Google Inc still claim the right to this word? The Google trademark is endangered because the word Google has become a generic trademark, just like "spam", or "kleenex". http://en.wikipedia.org/wiki/List_of_generic_and_genericized_trademarks |
Yes you are right Philipp .
People even use the word Google to describe google as a person, but I think Chmoogle want to join Google, that's why they towards this move. |
yeah its like someone said..lets call it "web sue.0" now!!
"google" and "oogle" and "Chmoggle" seems to be a distinct term IMHO.
|
Chmoogle is obviously a mash-up of "Chem" + "Google." While you may argue that Google is fast becoming a common phrase, that provides all the more incentive for Google to aggresively watch out for violations of its name. Google will only really become a public phrase when Google stops defending it. |
The distinction between google as a verb, and Google the company is clear to me. While we use kleenex, you can't start a company related to the kleenex product, and have the term "kleenex" in the name, that would be iilegal
<<Kleenex is a brand name of facial tissue paper and a registered trademark of the Kimberly-Clark Corporation. Because of the success of this brand, it has become a genericized trademark in American English and many people in Northern America today refer to any tissue as a "Kleenex". However, Kleenex remains a trademark legally referring only to the product of Kimberly-Clark.>> http://en.wikipedia.org/wiki/Kleenex
Google like kleenex remains a legally protected trademark/brand name.
Chmoogle is using the reputation and brand of Google to advance its search engine. This can be confusing, and as such, Google should protect its brand. If Google Blogoscoped was a blog search engine, that would definately be infringing on Google's brand. But in the context "Google Blogoscoped" is being used, the chances of confusion are much lower, so in that case there is no need for Google to go after Philipp -:) |
I wonder why they haven't done anything about f*ckedgoogle.com. |
